Russell Edelstein is an associate in the Major Commercial Litigation Group, which has been recognized with a “Go-to Firm” designation in Litigation by Corporate Counsel in “Who Represents America’s Biggest Companies.”  Mr. Edelstein’s experience within the Major Commercial Litigation Group spans from pre-litigation negotiations to completion of trial, where he has managed extensive electronic document discovery, conducted depositions of fact witnesses in complex contract actions, and drafted memoranda of law in support of dispositive motion practice and trial in federal and state courts.

Prior to joining Choate in 2005, Mr. Edelstein was a management consultant, primarily working with pharmaceutical industry clients.  Mr. Edelstein was also a project coordinator with the Administration Department of Lemuel Shattuck Hospital, a public hospital within the Massachusetts Department of Public Health.

Practice Focus

Major Commercial Litigation:  cases addressing insurance coverage disputes, contract litigation involving pharmaceutical development, commercial supply contracts and real estate contracts. 

Representative Engagements

  • Representation of major national financial products company in commercial litigation involving pharmaceutical joint funding and development contract at bench trial in federal district court.
  • Defended enforceability of state authority’s contracts against private parties challenging the agreements as void under federal statute and the U.S. Constitution.
  • Conducted depositions of defendant and third-parties in complex contract dispute in support of rescission claim.
  • Managed associate document review team defending company controller in SEC options-backdating investigation. 
  • Prepared witnesses for grand jury and proffer appearances in federal Anti-Kickback and False Claims Act investigations of pharmaceutical company executives.
